Welcome to ImageTransform. These Terms of Use ("Terms") govern your access to and use of the ImageTransform mobile application ("App") provided by ImageTransform ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age (or the applicable age of consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under the age of 18, you must have the consent of a parent or legal guardian.

2. Account Registration

To use certain features of the App, you may sign in using Apple Sign-In, Google Sign-In, or continue as an anonymous user. You are responsible for:

• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

ImageTransform is an AI-powered image transformation service that allows you to:

• Upload photos from your device.
• Select style templates to transform your photos using artificial intelligence.
• Generate AI-transformed images and videos.
• View and manage your generation history.

The App uses AI models to process your images. Results may vary and are not guaranteed to meet specific expectations.

4. Credits and Purchases

4.1 Credit System

The App operates on a credit-based system. Each image or video generation consumes credits from your account balance. Credits may be obtained through:

• Initial free credits provided upon account creation.
• In-app purchases through the Apple App Store.
• Promotional offers at our discretion.

4.2 In-App Purchases

All in-app purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. By making a purchase, you agree to the following:

• All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.
• Prices are displayed in your local currency and may vary by region.
• We reserve the right to change pricing at any time. Price changes will not affect previously completed purchases.

4.3 Subscriptions

If you purchase a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate.
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5. User Content

5.1 Your Photos

You retain ownership of the original photos you upload to the App. By uploading photos, you grant us a limited, non-exclusive, worldwide license to:

• Process and transform your photos using our AI models.
• Store your photos on our servers for the purpose of providing the service.
• Create and store generated media derived from your photos.

This license exists solely for the purpose of operating and providing the App's services to you.

5.2 Generated Content

AI-generated images and videos created through the App are provided for your personal use. You may use generated content for personal, non-commercial purposes. For commercial use of generated content, please contact us.

5.3 Content Restrictions

You agree not to upload, generate, or attempt to generate content that:

• Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Infringes on the intellectual property rights of any third party.
• Contains sexually explicit or pornographic material.
• Depicts violence, gore, or cruelty.
• Involves minors in any inappropriate context.
• Impersonates another person for fraudulent or deceptive purposes.
• Violates any applicable law or regulation.

We reserve the right to remove any content that violates these restrictions and to suspend or terminate accounts of users who violate them.

6. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App or its AI models.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Use automated scripts, bots, or other means to access the App or generate content in bulk.
• Circumvent or attempt to circumvent the credit system or any usage limitations.
• Resell, redistribute, or sublicense access to the App or its features.
• Use the App to develop a competing product or service.
• Upload malicious files, viruses, or any harmful code.

7. Intellectual Property

The App, including its design, features, AI models, style templates, code, graphics, and all related intellectual property, is owned by us and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except for the limited right to use the App in accordance with these Terms.

8. AI-Generated Content Disclaimer

The App uses artificial intelligence to generate transformed images and videos. You acknowledge and agree that:

• AI-generated results may be unpredictable and may not always meet your expectations.
• We do not guarantee specific outcomes, quality, or accuracy of generated content.
• AI models may occasionally produce unexpected, inaccurate, or unintended results.
• Credits consumed during generation are non-refundable regardless of the quality of the output.
• You are responsible for reviewing generated content before sharing or publishing it.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, error-free, or secure.
• Any defects will be corrected.
• The results obtained from using the App will be accurate or reliable.
• The quality of any generated content will meet your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ImageTransform, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you upload or generate through the App.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the App ceases immediately.
• We may delete your account data, uploaded photos, and generated media.
• Any unused credits will be forfeited and are non-refundable.

You may stop using the App at any time. Sections 7, 9, 10, 11, and 14 survive termination.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ImageTransform regarding your use of the App and supersede any prior agreements.
